Our partner Maria Derelieva, PhD student in Administrative Law and Procedure at Plovdiv University “Paisii Hilendarski”, published an article in the prestigious medical publication on “Analysis of the case law on claims for payment of “over-the-limit” medical activities of healthcare establishments that have concluded a contract with the National Health Insurance Fund”.
The article provides a systematic review of three consecutive decisions of the Supreme Court of Cassation on the controversially resolved by the lower courts disputes for payment of “over-the-limit“ medical activities of the healthcare establishments that have concluded contracts with the Health Insurance Fund. The decisions of the Supreme Court of Cassation award payment for this activity to the healthcare establishments by the Health Insurance Fund. The article also comments on the rulings of the cassation instance, on which significant substantive issues concerning the legal nature and legal consequences of the clauses, establishing monthly monetary values (so-called “limits“) in the contracts for providing hospital care, are admitted for consideration.“
