At the end of June 2020, Georgiev, Todorov & Co. Law Offices successfully defended the rights of the state enterprise Port of Burgas in an administrative case on appeal against a decision of the Energy and Water Regulatory Commission under the Energy Act, resolving a dispute for connection to the national electricity transmission grid.
An essential issue for resolving the dispute was the subject of the proceedings before the Court of Justice on a reference for a preliminary ruling in relation to another business consumer, also represented by the law firm. With a clear and definite position, fully adopted by the national administrative court, the CJEU ruled that the voltage level is not the only determining criterion to consider whether a customer is treated as connected to the electricity transmission or distribution grid (Decision of 17.10.2019 of the CJEU on case C-31/18).
Thanks to a successful court representation provided by our lawyers Miglena Peneva and Maria Derelieva, the Administrative Court of Sofia-city dismissed at first instance the appeal of the electricity distribution operator and recognize the right of the state enterprise of direct connection to the electricity transmission grid.
